Homosexual Panic in the High Court:
A discourse analysis of Green v R.

The High Court's decision in Green raises serious ethical issues about the apparent acceptance by the High Court of lethal violence against homosexual victims in defence of an outraged masculinity. Legal discourses may be viewed as a contest of the truths, not least a contest of truths around the body, about what may be said and who is authorised to speak.

The paper will present a reading of the High Court decision in Green and its failure to adequately and unequivocally provide equal protection against lethal violence to the homosexual members of the community.
